General Terms andConditions – Valeries Pictures

Article 1 – Applicability

These general terms and conditions apply to all quotations, bookings, agreements, and services provided by Valeries Pictures.

By booking a photoshoot, the client agrees to these general terms and conditions.

Article 2 – Booking

A photoshoot is considered confirmed once the appointment has been agreed upon by both parties.

Valeries Pictures reserves the right to refuse a request without stating a reason.

Article 3 – Payment

Unless otherwise agreed, payment must be made no later than the day of the photoshoot.

Photos will only be delivered after full payment has been received.

Article 4 – Cancellation and Rescheduling

Cancellations may be made free of charge up to 48 hours before the scheduled photoshoot.

In the event of cancellation within 48 hours, Valeries Pictures reserves the right to charge for costs already incurred.

In the event of bad weather or other circumstances preventing the quality or safety of the photoshoot from being guaranteed, the appointment will be rescheduled to a new date free of charge.

Article 5 – Force Majeure

If the photographer or the client is unable to attend due to illness, force majeure, or unforeseen circumstances, a new date will be scheduled in consultation.

Neither party shall be held liable in such instances.

Article 6 – Responsibility

The owner remains responsible for their dog throughout the entire photoshoot.

Valeries Pictures will always prioritize the dog's well-being and will never force a dog into poses or situations that cause stress, fear, or danger.

If the photographer believes that the safety of humans or animals is at risk, the photoshoot may be terminated.

Article 7 – Delivery

After the photoshoot, Valeries Pictures selects the best photos.

The photos undergo professional post-processing.

Delivery generally takes place within 2 to 4 weeks via Pixieset or WeTransfer, unless agreed otherwise.

Raw (RAW) files are not provided.

Article 8 – Copyright

All photos remain the property of Valeries Pictures.

The client receives a right of personal use.

It is not permitted to:

* use photos for commercial purposes;

* resell the photos;

* publish the photos for commercial purposes without permission;

* edit the photos extensively in a way that compromises the photographer's work.

Posting on social media is permitted, provided the photos are not edited in a way that alters the photographer's quality or style. Crediting Valeries Pictures is appreciated.

Article 9 – Portfolio and promotion

Valeries Pictures may use the photos taken for:

* the website;

* social media;

* portfolio;

* promotional purposes.

If the client objects to this, they must indicate this in writing or via email prior to the photoshoot. Valeries Pictures will respect this.

Article 10 – Liability

Valeries Pictures is not liable for damage, injury, loss, or theft of property or animals during or after the photoshoot, unless caused by willful misconduct or gross negligence.

In all cases, liability is limited to the amount paid for the photoshoot in question.

Article 11 – Complaints

Complaints regarding the services provided must be submitted via email within 14 days of the delivery of the photos.

Valeries Pictures will make every effort to reach a suitable solution together with the client.

Article 12 – Privacy

Personal data is processed in accordance with Valeries Pictures' privacy statement.

Article 13 – Applicable law

All agreements are governed exclusively by Dutch law.

Disputes shall be submitted to the competent court in the Netherlands.
